Terms and Conditions for Real Estate Photographers
1. Definition
-Client: Refers to any real estate agent, broker, or representative who has booked services with {Business Name}.
-Photographer: Refers to any individual or entity representing {Business Name} responsible for capturing and processing photos.
2. Booking and Scheduling
-It is the responsibility of the Client to advise its Clients (vendors, tenants, landlords) of appropriate appointment times.
3. At the Shoot
Properties will be shot "as is." so it is encouraged that the property be clean, staged, and photo-ready at the scheduled time. Any post-production item removal requests will incur additional charges.
The Photographer reserves the right to refuse to photograph any part of the property if safety or legal concerns arise.
If the property is not ready for photography upon arrival and the shoot takes longer than scheduled, a $50 fee will apply for the additional time required.
Homes will be photographed as they are presented at the time of the shoot. The photographer will only perform minimal staging adjustments, such as repositioning a chair or small decorative item, to enhance the composition of the images. Extensive staging or cleaning is not included in the photography service. Clients are responsible for ensuring the property is prepared to their own standards prior to the scheduled appointment.
If an appointment is canceled within two (2) hours of the scheduled time, or if the property is not ready and a cancellation occurs on-site, you will still be charged the full amount so make sure to reschedule if the property is not ready yet.

4. Cancellation and Rescheduling
Cancellations:
If you cancel less than 24 hours before your scheduled shoot, 50% of the total shoot fee will be charged.
Rescheduling:
Reschedules made within 24 hours of the shoot will incur a $25 fee.
Reschedules made within 5 hours of the shoot will incur a $75 fee.
Please note that fees are applied to cover the time and resources allocated to your appointment. Thank you for understanding!
Reshoots & Revisit Policy:To ensure efficiency and maintain availability for all clients, appointments are scheduled for full property coverage. If the Client chooses to proceed with an appointment during inclement weather (e.g., rain, fog, or snow) for interior coverage only, a separate Revisit Fee of $100 will apply if exterior photos are requested at a later date.
Revisit fees cover additional travel, scheduling, and setup time required for a second appointment. To avoid this charge, Clients are encouraged to reschedule for a date when both interior and exterior areas can be captured in one session.
5. Copyright and Usage Rights
-The Photographer retains full copyright ownership of all photographs, videos, floor plans, or graphics created.
-The Client is granted a non-exclusive license to use the images solely for marketing the specific property while the listing is active. The license expires once the property is sold, rented, or otherwise removed from the market.
-This license is non-transferable. The Client may not resell, license, sublicense, gift, assign, or transfer any rights to the photographs.
-The Photographer retains the irrevocable right to use the images for marketing, self-promotion, or other purposes, including but not limited to websites, brochures, and social media.
6. Liability and Indemnification
-The Photographer’s liability is limited to the professional fees paid by the Client for the specific shoot.
-The Client warrants that necessary permissions for access to and photographing the property have been obtained.
-The Photographer accepts no liability for property damage, injuries, or legal issues arising from the shoot. The Client agrees to indemnify, defend, and hold harmless the Photographer from any claims or legal proceedings related to photographing the property.
-The Photographer is not responsible for delays or cancellations caused by circumstances beyond our control, including weather or property unavailability.
-The Client assumes responsibility for ensuring the property is safe and accessible for the Photographer.
7. Delivery and Inspection
-Edited images will be delivered within 24-48 hours after the shoot. Videos or additional services may require more time.
-Clients must inspect all delivered works within 3 days. After this period, the Photographer will not be liable.
8. Independent Contractor Relationship
- {Business Name} operates as an independent contractor. No agency, partnership, or employer-employee relationship is created through this agreement.
